DHS to update Form I-9

An updated version of Form I-9, Employment Eligibility Verification, will be released by U.S. Citizenship and Immigration Services (USCIS) this coming August. One notable change is a checkbox for E-Verify-enrolled employers to demonstrate that they have inspected identity and employment authorization documents remotely.

With news about the revised I-9, DHS also announced that it will permit employers who use E-Verify to examine their employees’ identity and employment authorization remotely, through a live video interaction with the employee, a departure from the traditional in-person examination.

Key changes to Form I-9 include:

– Sections 1 and 2 will be merged into a single-sided sheet, allowing it to be a fillable on tablets and mobile devices;

– Preparer/Translator Certification will be moved to a separate standalone supplement, to be provided only when necessary;

– Similarly, the Reverification and Rehire section also will become a standalone page, to be filled  when needed;

– The List of Acceptable Documents will be updated to include a list of acceptable receipts, as well as guidance on automatic extensions of employment authorization documentations; and

– a Reduction of the number of pages in the form’s instructions.
